Marriage License Requirements & Eligibility
Preparing to marry in the Philippines? Check the documents for both applicants, Davao City residence rules, counseling requirements and any additional paperwork based on age, nationality or previous marital status.
Before gathering documents: This is an office-based marriage-license application. A marriage license is obtained before the ceremony and is different from the Certificate of Marriage registered after the wedding. The visuals below are illustrated document guides, not official forms.
Documents Both Applicants Should Prepare
The City’s published checklist asks applicants to show original records for examination and provide copies. The following core documents are generally required of both parties.
View 4K image ↗
Core Document Checklist
- Birth Certificate: PSA-issued or local-issued; 1 original and 2 photocopies for each applicant.
- PSA CENOMAR: Certificate of No Marriage; 1 original and 2 photocopies per applicant in the City’s published checklist.
- Pre-Marriage Counseling Certificate / Certificate of Compliance: 1 original and 2 photocopies from the appropriate health office or accredited provider.
- One additional supporting record: baptismal certificate, voter’s affidavit or school record / transcript — 1 original and 2 photocopies.
- Valid identification: bring each applicant’s government-issued ID and 2 photocopies each.
Check names, birth dates, current civil status and parent details across all records. Bring originals even when copies are retained.
Parental Consent, Parental Advice & Age Eligibility
The law and Davao City’s checklist distinguish parental consent from parental advice. Each applicant’s age determines which requirement applies.
View 4K image ↗
Which Document Applies?
- Under 18: Philippine law does not permit marriage, including with parental consent.
- Ages 18–20: notarized parental consent and the required appearance or lawful execution by the appropriate parent/guardian.
- Ages 21–25: notarized parental advice and supporting formalities under the City’s published checklist.
- Age 26 and above: no age-based parental-consent or parental-advice affidavit, but all other applicable requirements remain.
- Parents unavailable: ask CCRO about the lawful substitute, supporting relationship proof and any required guardianship affidavit.
If parental advice is unavailable or unfavorable, Family Code Article 15 provides a possible three-month delay after publication. Ask CCRO how this affects your application.
Consent and proper legal execution required.
Advice and sworn-statement rules apply.
Continue with ordinary documentation and review.
Verify Where to Apply and Complete Counseling
A marriage license is normally requested from the local civil registrar where either contracting party habitually resides. For Davao City filing, confirm that at least one applicant meets the city’s residence condition.
View 4K image ↗
Complete These Checks Before Filing
- Residency: provide acceptable proof that at least one party is a Davao City resident; verify what the receiving office accepts.
- Barangay certification: the City’s checklist identifies 1 original and 2 photocopies when applicable to a nonresident applicant’s proof.
- Counseling: obtain the certificate through the City/Municipal Health Office or accredited agency. The Davao City Health Office lists pre-marriage counseling at district health centers.
- IDs: prepare the couple’s valid IDs with the listed photocopies.
- Cedula: prepare the community tax certificates of the applying parties and parents when required for notarization or filing.
Check the counseling schedule, provider requirements and possible counseling fee before visiting. Counseling attendance and marriage-license filing are separate procedures.
Foreign Applicants, Previous Marriages & Other Cases
Only prepare these additional records where applicable. Complex legal status, foreign civil records and previous marriages may need certified records and case-specific CCRO review.
View 4K image ↗
When Additional Proof Is Needed
- Foreign national: Certificate of Legal Capacity to Marry from embassy/consulate, or duly apostilled documentation when acceptable. The City’s checklist specifies 1 original and 5 photocopies.
- Foreign passport: photocopies of the passport bio page and page showing arrival in the Philippines — 2 copies each.
- Widow or widower: deceased spouse’s death certificate — 1 original and 2 photocopies.
- Annulled / nullity: certified judicial decision or decree, finality, annotated marriage record and Advisory on Marriage, as applicable.
- Foreign divorce / Sharia cases: special legal review and supporting decisions may be necessary. Ask CCRO for the correct case-specific checklist.
A foreign divorce document alone may not establish legal capacity for every Filipino applicant. Do not assume a foreign decree automatically changes Philippine civil status.
Important Exceptions & Filing Reminders
These details can prevent an unnecessary second office visit. Requirements differ for individual cases; ask the Marriage Registration Division to assess unusual situations.
Parent or Guardian Cannot Appear
Davao City’s checklist provides for supporting affidavits involving available parents or appropriate relatives, with guardianship documentation if required. The correct legal order and supporting proof must be evaluated by CCRO.
Parental Advice Not Given or Is Unfavorable
Article 15 of the Family Code may delay issuance for three months after publication. Discuss the required sworn statement and written response with the registrar.
Indigent Applicants
Article 19 of the Family Code provides for license issuance without charge for qualifying indigent applicants subject to required proof. Ask CCRO how to establish eligibility.
License vs. Marriage Certificate
The license authorizes the intended marriage, while the Certificate of Marriage is executed after the ceremony and registered separately. A marriage license is normally valid for 120 days from issuance anywhere in the Philippines.
Final Marriage License Checklist
- Both applicants available for personal appearance.
- At least one applicant’s Davao City residence verified.
- Birth certificates and CENOMAR prepared with copies.
- Counseling or compliance certificate obtained.
- One additional supporting document ready.
- Valid IDs, residency proof and Cedula checked.
- Age-related consent/advice documents if applicable.
- Special documents checked for foreign or prior marriages.

Correct Any Missing or Inconsistent Details
Check both applicants’ names, ages, parents’ details, residence and existing marital status. The receiving officer may require special supporting documents before allowing the application to proceed.
Receive the Order of Payment
After document screening, CCRO issues an Order of Payment. Use that genuine assessment for the next step. The 2026 Charter gives 15 minutes as the agency estimate for initial screening and assessment.
Pay, Complete and Notarize Your Application
Davao City’s 2026 procedure places payment before issuance of the application form to be completed and notarized.

Pay at the City Treasurer’s Office
Present the Order of Payment at the authorized City Treasurer’s Office payment counter. The 2026 Citizen’s Charter lists ₱500 for Filipino applicants and ₱750 for the foreign-applicant category.
These are published charges for the stated procedure; unusual cases or legal exemptions require official assessment.
Keep and Return Your Official Receipt
Obtain the genuine Official Receipt and return it to the CCRO receiving clerk. Do not send fees to personal bank accounts or rely on screenshots of unofficial payment instructions.
Receive and Accomplish the Marriage License Application Form
After presenting the receipt, receive the Marriage License Application Form from CCRO. Complete the required details accurately, matching the documents of both applicants.
Check names, civil status, residence, dates and any required statements before signing.
Use the form and signing instructions issued by the Marriage Division; illustrations do not replace official forms.

Have the Application Properly Notarized
Follow the notary’s identification, appearance and sworn-signing requirements. Review the finished notarized application to make sure all necessary fields, signatures and notarial details are complete.
Do not assume notarization cost is included in the CCRO marriage-license charge.Resubmit the Application & Allow the Required Posting
The complete notarized application is reviewed by CCRO, then an official public notice is posted for ten consecutive days.

Allow the Mandatory 10-Day Public Notice
Under Article 17 of the Family Code, the local civil registrar posts a notice of the intended marriage for ten consecutive days. This is a legal requirement; staff-processing minutes do not shorten it.
If there are special circumstances, a legal impediment or outstanding requirements, the final release instructions can differ.
Confirm the Date for Collection
The 2026 Davao City Charter instructs applicants to return on the 11th day after submission to claim the Marriage License. Confirm the specific date and office arrangements before traveling, particularly around weekends, holidays or special-case reviews.
Collect, Verify and Use the Issued Marriage License
Once the required posting is complete and the application is ready for issuance, return for the document.
Return to CCRO and Claim the Marriage License
Go back on the date given by CCRO, bring identification and relevant receipt or claim details, and follow the Marriage Division’s collection procedure.
The 2026 Charter provides a 3-minute agency release estimate, excluding queues or exceptional delays.

Check the Issued License and Sign the Logbook
Review both applicants’ names, the license number, issuance date and stated expiration date. CCRO asks the receiving applicant to sign its logbook as proof of receipt. Keep the issued license safe for the marriage ceremony.
Arrange the Ceremony Within the 120-Day Validity
Under Article 20 of the Family Code, the license is valid anywhere in the Philippines for 120 days from its date of issuance. If it expires unused, the license is automatically canceled.
The marriage ceremony and subsequent registration of the Certificate of Marriage are separate steps.
Before the Wedding: Final Checks
A Marriage License is permission to proceed with the intended marriage. It is not the marriage ceremony and is not the Certificate of Marriage. Before making wedding arrangements, confirm the authorized solemnizing officer, wedding venue, any required ceremony documents and validity of the issued license.
- Names do not match: ask CCRO for correction instructions before using the license.
- Claim date has changed: contact the receiving Marriage Division rather than assuming the notice period was waived.
- Special legal situation: lack of parental advice, foreign documents or prior marriages can require additional review.
- After the wedding: the authorized solemnizing officer and relevant registrar handle registration of the Certificate of Marriage.

Official Marriage License Fee Breakdown
The Davao City Government’s published requirements itemize the base ₱500 charge and an additional fee applicable to the foreign-applicant category. Pay only the amount on the genuine City Treasurer’s Office assessment.
Where to pay: Take the Order of Payment issued after CCRO screening to the City Treasurer’s Office. Obtain an Official Receipt and return it to the Marriage Division, following its instructions.
Fee exemption: Article 19 of the Philippine Family Code provides for a marriage license without charge to qualifying indigent applicants whose inability to pay is established under the legal rules. Ask CCRO how to apply. Notarial, certificate, counseling or embassy costs may be separate and must not be treated as included in these totals.
Processing Timeline: From Screening to Release
These are published agency-processing stages for an otherwise complete application. The ten-day posting cannot be skipped simply because the office review took only a few minutes.
CCRO Document Screening
Both applicants present documents. The office checks eligibility and prepares the Order of Payment.
Notarized Form Review
After payment, form completion and notarization, CCRO reviews the submitted application.
Mandatory Public Notice
The notice of intended marriage is posted for ten consecutive days as required by law.

Excludes cashier queues, document-gathering, counseling, notarization and exceptional review. CCRO normally instructs applicants to return on the 11th day after submitting the application; confirm the actual office claim date.
What Other Costs Might Apply?
These expenses depend on the couple’s documents and circumstances. They are not part of the basic Marriage License charge shown above.
PSA Birth Certificate and CENOMAR
Ordering required civil registry documents from an authorized PSA channel has separate request fees.
Application or Parental Affidavit Notarization
Notarial service charges vary. Younger adult applicants may need parental-consent or parental-advice affidavits.
Pre-Marriage Counseling or Certifications
Ask the authorized health office or accredited provider about scheduling, required IDs and any applicable fee.
Foreign Documents and Legal Capacity
Embassy/consulate paperwork, certified foreign records, translations or apostille services may create additional costs.
When Does the Marriage License Expire?
The 120-day validity period begins on the date of issuance, not when the couple first applies or pays. Article 20 of the Family Code makes the license usable anywhere in the Philippines during that period. An unused license is automatically canceled at expiry; check the exact expiry date stamped on the document.

From Marriage License to Registered Marriage
Receiving your license is an important step, but it does not mean you are already married. Here is what to do before the ceremony, how the Marriage Certificate is registered, and when to request a PSA-certified copy.
Six steps after your license is issued
Start by checking the expiry date on the license. Then arrange the ceremony with a legally authorized solemnizing officer and make sure the signed Marriage Certificate reaches the correct local civil registrar.
Getting married outside Davao City? Your valid license may be used anywhere in the Philippines, but the Marriage Certificate is registered where the ceremony actually takes place.
Check the license and its expiry date
Check both applicants’ names, license number and issuance date. Under the Family Code, the license is valid 120 days from issuance anywhere in the Philippines. If it expires unused, a fresh license application is normally needed.
Arrange the ceremony and witnesses
Confirm that the priest, judge, mayor or other solemnizing officer is legally authorized to perform the marriage. Both parties must appear and declare their consent before that officer and at least two witnesses of legal age. Give the officer the license and other documents requested for the ceremony.
Complete and sign the Marriage Certificate
After the ceremony, the couple, witnesses and solemnizing officer sign the Certificate of Marriage (COM). Review names, marriage date, venue and license details. Davao City’s timely registration checklist specifies four copies of the completed COM signed by the solemnizing officer.
Make sure the certificate is submitted on time
The solemnizing officer is responsible for sending the required certificate copies to the civil registrar where the marriage was celebrated within 15 days. Ask the officer how submission and confirmation will work. If the marriage was held outside a normally authorized venue, Davao’s checklist may require a supporting request letter.
Complete local Marriage Certificate registration
For a wedding held in Davao City, CCRO reviews the required documents and issues an Order of Payment. Pay the published ₱250 registration fee at the City Treasurer’s Office, then return the Official Receipt. CCRO assigns a registry number, signs and releases the local registered COM. Its published administrative processing estimate is 19 minutes for a complete routine application, excluding cashier queues.
Request a PSA Marriage Certificate when available
The local registered COM and the PSA-issued Marriage Certificate are not the same document. PSA availability depends on transmission and processing, so it is not necessarily immediate. Once available, request a copy through an authorized PSA service. If PSA cannot find the record, first verify the local registration before taking further action.
Marriage License vs. Marriage Certificate
These two documents serve different purposes. Knowing which one you need prevents confusion when planning a wedding or completing official paperwork after the ceremony.
Marriage License
Issued before the wedding. It permits the intended marriage during its 120-day validity, unless a legal license exemption applies.
Marriage Certificate (COM)
Completed at the wedding and recorded afterward by the responsible local registrar. A PSA-issued certificate can be requested once the record becomes available.
Important: If the ceremony has already taken place but the COM was not registered on time, ask the registrar about delayed marriage registration. Do not try to solve a missing marriage record by applying for another marriage license.

Common Marriage License Problems & Solutions
Missing documents, conflicting civil records and unexpected delays can hold up a marriage-license application. Find the issue that matches your situation, open its explanation and follow the next step before returning to the Davao City Civil Registrar’s Office.
Before Submitting the Application
Issues 01–0501 A birth certificate, CENOMAR or required document is missing.
Davao City’s checklist requires original documents for examination and the stated photocopies. Both applicants normally need their birth records, CENOMAR, counseling certificate, valid IDs and an accepted additional supporting record. An incomplete packet can be returned for completion.
What to do: Compare your documents with the requirements checklist. Obtain the missing record from the correct issuing authority, check the personal details and prepare the required copies before revisiting CCRO.
02 One applicant cannot appear at the Civil Registrar’s Office.
The Davao City requirements expressly call for the personal appearance of both contracting parties. A relative carrying one person’s documents is not an automatic substitute. An appointment with only one applicant may therefore be insufficient for the initial application.
What to do: Arrange a visit when both applicants can attend. If there is a serious medical or other exceptional impediment, contact CCRO in advance and ask whether any lawful accommodation applies; do not assume an ordinary authorization letter is enough.
03 Parental consent or parental advice is unavailable.
Applicants aged 18–20 need parental consent; those aged 21–25 must seek parental advice. These are different legal requirements. If advice for a 21–25-year-old applicant is not obtained or is unfavorable, the Family Code provides for a three-month delay after publication before the license may be issued.
What to do: Explain who is unavailable and why. Bring relevant relationship, death or guardianship records where applicable, and ask CCRO who may lawfully execute the required statement. If the applicant is under 18, a marriage license cannot be issued.
04 Pre-marriage counseling is unfinished or the certificate is missing.
The local checklist calls for a Pre-Marriage Counseling Certificate or Certificate of Compliance issued by the appropriate health office or accredited provider. Attendance and the marriage-license application are separate tasks, so completing the CCRO documents does not replace the required counseling record.
What to do: Verify the approved provider, session arrangements and accepted proof before paying or booking elsewhere. Attend the necessary session, secure the original certificate and prepare the required copies for submission.
05 A foreign nationality or previous marriage needs additional proof.
Foreign applicants may need a Certificate of Legal Capacity to Marry and passport records. Widowed applicants may need the previous spouse’s death certificate; annulment, nullity and foreign-divorce situations can require certified decisions, finality and annotated civil records. A previous-marriage entry on PSA records must not simply be ignored.
What to do: Ask the Marriage Division to assess the exact legal status and document format before paying for translations, apostilles or additional copies. Do not treat a foreign divorce decree as automatically sufficient in every Philippine case.
During Filing and License Release
Issues 06–0806 Names, dates or civil-status details do not match across documents.
Differences between a birth certificate, CENOMAR, identification and the Marriage License Application can lead to further examination. A simple typing error on an unsigned draft is different from an error in an officially registered civil record, which may need a separate correction procedure.
What to do: Identify the conflicting field, keep the genuine original documents and ask CCRO which record must be corrected or explained. Do not overwrite, erase or create altered civil-registry documents to make the details appear consistent.
07 Ten days have passed, but the marriage license is not ready.
The ordinary application requires a ten-consecutive-day public notice. Davao City’s 2026 procedure instructs applicants to return on the 11th day after submitting the completed application, but incomplete requirements, legal concerns or collection arrangements may affect the actual release.
What to do: Check the date the complete notarized application was accepted, not just the day you first visited or paid. Bring your official receipt and claim details, and ask the Marriage Division to confirm whether posting and document review are finished.
08 The issued marriage license was lost, damaged or has expired.
A marriage license is valid for 120 days from its issuance date anywhere in the Philippines. If it expires without a wedding, the law treats the unused license as canceled. A lost or damaged license is a different problem and should be checked against the issuing office’s record.
What to do: For an expired license, ask CCRO about applying afresh. If it is lost or damaged but still valid, contact the issuing registrar first about verification and any available official replacement procedure; do not use a homemade copy as the original.
After the Wedding Ceremony
Issues 09–1009 The Marriage Certificate was not registered within 15 days.
For an ordinary marriage, the solemnizing officer is responsible for submitting the Certificate of Marriage to the registrar where the ceremony took place within 15 days. When the deadline is missed, the couple should determine whether the local marriage record was ever registered and whether delayed registration now applies.
What to do: Contact the solemnizing officer and the civil registrar of the wedding location. Ask whether the signed Certificate of Marriage was received and, if not, which delayed-registration requirements apply. Applying for another marriage license will not register an existing marriage.
10 The marriage is registered locally, but PSA says “No Record Found.”
A locally registered Certificate of Marriage and a PSA-issued copy are separate records and services. A negative PSA search does not prove the marriage was never registered. The responsible local registrar can verify the entry and determine whether record transmission or electronic endorsement is appropriate.
What to do: Bring the local registration details to the registrar where the wedding was celebrated. If the local record exists, ask about electronic endorsement, which PSA states is free. A separate request for a PSA certificate may have its own charge.
Before You Contact the Civil Registrar
Prepare the relevant information so the office can identify the problem quickly. For an application issue, bring both applicants’ documents and the actual Official Receipt. For an issue after the wedding, bring the wedding date, place, solemnizing officer’s details and any local Marriage Certificate or registry number.
- Correct names and dates
- Genuine original records
- Application or receipt reference
- Specific issue to be resolved
For Davao City cases, CCRO can be contacted at (082) 241-1000 locals 364/365 or [email protected]. For a wedding held elsewhere, start with the civil registrar of the actual ceremony location.

Marriage License Frequently Asked Questions
Here are straightforward answers to the questions couples most often ask before applying in Davao City. Select a question to read the answer, then continue with the relevant section if you need more detail.
01 Can we apply in Davao City if only one of us lives there?
Yes. The marriage-license application is ordinarily filed with the local civil registrar where either applicant habitually resides. If one of you is a Davao City resident, you can use the city’s procedure, provided you meet its other requirements. Bring valid identification and whatever residence evidence CCRO requests. You do not both need to be Davao City residents.
02 Do both applicants need to visit the Civil Registrar personally?
Yes. Davao City’s checklist requires the personal appearance of both contracting parties. Bring valid IDs, original records and the required photocopies for examination. The process includes document screening, payment, preparation of the marriage-license application and notarization. Do not assume one partner can complete the entire application alone or through an unofficial online form.
03 What documents should we prepare before applying?
Prepare each applicant’s birth certificate, CENOMAR, valid ID and pre-marriage counseling or compliance certificate. Davao City also asks for one accepted supporting record, such as a baptismal certificate, voter’s affidavit or school record. For the principal certificates, the published checklist generally lists one original and two photocopies. Age, nationality and previous marital status may add requirements.
Check the full requirements section before collecting documents so you do not miss an applicable affidavit.
04 What are the parental consent and parental advice rules?
Applicants aged 18–20 need parental consent, while those aged 21–25 must seek parental advice. Davao City specifies notarized documents and the applicable parent’s appearance. If advice is unavailable or unfavorable, the Family Code can require an additional three-month delay after publication. Marriage below age 18 is not permitted, even with parental consent.
05 Can foreign nationals or previously married applicants apply?
Yes, when legally eligible. Foreign applicants generally need proof of legal capacity to marry and passport records. A widow or widower may need the previous spouse’s death certificate; annulment, nullity or foreign-divorce cases can require court decisions, finality and annotated civil records. These documents require case-specific examination, so confirm the applicable list before paying for certifications or translations.
06 How much does a license cost, and when can we collect it?
Davao City’s published charges total ₱500 for the Filipino category and ₱750 for the foreign-applicant category, subject to official assessment. Notarization and document-request costs may be separate. Once the complete notarized application is accepted, the required notice is posted for ten consecutive days. The ordinary procedure directs applicants to return on the 11th day; ask CCRO for your actual claim date.
07 How long is the license valid, and can we marry outside Davao City?
A marriage license is valid for 120 days from its issuance date and can be used anywhere in the Philippines during that period. You may arrange the ceremony outside Davao City with a legally authorized solemnizing officer. If the license expires unused, it is automatically canceled. The Marriage Certificate must later be registered with the civil registrar where the wedding actually takes place.
08 Is a Marriage License the same as a PSA Marriage Certificate?
No. The marriage license is issued before the ceremony. The Marriage Certificate is signed as part of the wedding and must then be registered. For an ordinary marriage, the solemnizing officer submits the required certificate copies to the registrar within 15 days. A PSA-issued Marriage Certificate is requested separately once the local record has been transmitted and becomes available.
